After skipping the New Year’s Day celebrations over the killing of Bhim Tank at liquor baron Shiv LalDoda’sRamsara farmhouse on December 11, the Dalit community today observed “black” Lohri.

Even otherwise, people had a black day here as there was no power supply till 5 pm due to some technical snags.

An emissary of Supreme Court advocate and leader of the AAP breakaway group PrashantBhushan met the Tank family and offered to provide free legal aid to pursue the murder case.

BahujanSamajMorcha representative Prof Harnek Singh visited Abohar and expressed his condolences. He told the media that he would take out a book about the incident that has been condemned by human rights organisations globally.

The Bhim Tank Murder Action Committee continued its chain fast today with the batch of Satish, Nony, Sanjay, Vicky and Ravi Pihwal observing a day-long fast at the dharna site in Sant Nagar.

Bhim’s father Kapoor Chand said that Chief Minister Parkash Singh Badal found time to conduct a SangatDarshan nearby, but could neither spare a few minutes to console the affected families here nor did he tell the police administration to intensify the drive to arrest Shiv LalDoda and the other accused.

“Even after 68 years of independence, Dalits remain soft targets by the mafia if they don’t follow their orders,” he said.

Sambalpur: A 16-year-old Scheduled Caste boy was brutally assaulted in custody by the Hirakud police over suspicions of theft, it emerged Wednesday after photographs of the incident were leaked.Sources said the incident occurred four months back.

A driver named BalaramKhujur employed with a construction company lodged a complaint with the Hirakud police claiming that his mobile phone was stolen during the Biswakarma immersion ceremony September 18. On the basis of the complaint lodged by Balaram, police picked up the minor boy from Sweeperpada and hauled him off to the police station.

There, the police proceeded to tie the boy’s hands and legs and began assaulting him black and blue. It was later alleged that Hirakud inspector in-charge (IIC) SabitriBal too joined in with other police personnel in kicking and hitting the boy.

The boy was made to spend the night at the police station. When his mother approached the police the next day and pleaded with them to free her son, the police allegedly demanded Rs 8,000 to do so. The boy was released only after the woman managed to arrange Rs 6,000, sources said.

When contacted for her statement, IIC Bal termed the allegations of torture as baseless.

Surprisingly, the Hirakud police had not registered any case regarding the mobile phone theft.

Sambalpur superintendent of police Akhileswar Singh has meanwhile asked Hirakud sub-divisional police officer AbakashRoutray to conduct an enquiry and submit a report within 12 hours.

New Delhi, Jan. 13: The NarendraModi government has tried to quietly roll back a promise of reservations for SCs, STs and OBCs in admissions to private educational institutions, made by the Manmohan Singh government in Parliament.

The human resource development ministry requested the parliamentary committee on government assurances, headed by Ramesh PokhriyalNishank, to drop earlier assurances by the ministry to bring a bill to provide for quotas to these disadvantaged groups.

The committee, in its report in the LokSabha on December 21, 2015, however, did not accept the request. Parliament will now decide on this issue.

Sugata Bose, Trinamul Congress MP and a member of the committee, told The Telegraph the committee did not find merit in the ministry’s request. “The committee said the assurance cannot be dropped. The assurances made on the floor of the House have to be fulfilled. Now Parliament will take the final call,” Bose said.

The assurances were made in reply to questions from MPs who had enquired about the implementation of the 93rd constitutional amendment. The amendment, passed with the support of all parties in both Houses of Parliament in 2005, created the scope for reservation for Scheduled Castes, Scheduled Tribes and Other Backward Classes in admissions to private educational institutions along with aided institutions.

It inserted into the Constitution Article 15(5) that says nothing shall prevent the State from making any special provision by law for the advancement of any socially and educationally backward classes of citizens or for SCs or STs in admission to educational institutions, including private institutions.

The UPA government in 2006 enacted the Central Educational Institutions (Reservation in Admission) Act, which provided for 27 per cent reservation for OBCs in admission to centrally funded institutions. These institutions have been offering 15 per cent reservation to Dalits and 7.5 per cent to tribals since Independence.

A law on reservations in private institutions was promised. In reply to an unstarred question on August 14, 2013, then junior HRD minister ShashiTharoor told the LokSabha a proposal to bring the law has been formulated by the ministry but “it needs detailed consultations and consensus amongst key stakeholders”.

The ministry has now defended its attempt to go back on the promise, arguing that the matter was sub judice.

“I would like to inform you that an SLP (Special Leave Petition) of the Union of India is sub judice in the Hon’ble Supreme Court against the judgement of Hon’ble High Court at Allahabad in the matter. It is not possible to fulfil the assurance at this stage as the matter is sub judice,” Amit Shukla, director (university policy) in the HRD ministry, said in an e-mail reply to a question from this newspaper.

The high court had in 2011 held that the 93rd amendment was unconstitutional as far as its application to private institutions is concerned. The Centre has challenged the judgment in the apex court.

However, P.S. Krishnan, a former secretary in the Union government and an expert on reservation issues, said the Supreme Court had in another case in May 2014 upheld the validity of the 93rd amendment.Therefore, there is no legal hurdle to bringing a law to provide for reservation in private institutions, Krishnan said. In the case of Pramati Educational Trust versus Union of India, a constitutional bench of the Supreme Court in May 2014 ruled that the 93rd amendment was “constitutionally valid”, the judgment said.

Krishnan said the UPA government was equally to be blamed for not bringing the law. It kept delaying the bill while assuring Parliament that it would come, he said.

Bose, a professor at Harvard University, said: “I am in favour of affirmative actions. The private institutions may make special drive to ensure disadvantaged students get education. That is slightly different from reservation-based policy.”

Noida: More than a year after being forced to go into hiding, Ashok Kumar, an anti-corruption activist who exposed rampant illegal sand mining along the Yamuna, has moved the Delhi high court, seeking police protection so that he could return to his home in Faridabad. The case will come up for hearing on January 15.

Kumar left his home in November 2014 after receiving death threats. The Faridabad resident claims that repeated requests by him for security have been ignored by the Haryana government.

He has now appealed to the Delhi high court to reopen his case for hearing so that he can return to his city with his family under police protection.

In his appeal, the whistleblower has said that though he has been given financial compensation under the SC/ST Prevention of Atrocities Act, he is yet to be relocated to a safe residence.

Kumar told TOI on Wednesday that he is still homeless and fears for his life. “Ever since I filed my first complaint against sand mining on Yamuna bank, my life has fallen apart. I have been on the run since November 2014. I want to go back to my Faridabad house and start afresh,” he said.

Kumar had, in March 2014, first brought to the National Green Tribunal’s notice the extent of damage, both ecological and financial, that was being caused by illegal mining in the Tilpat Forest Range, a 4,000-acre stretch between Faridabad and Noida on the banks of the Yamuna.

“Illegal sand mining in the Tilpat range has led to the removal or theft of at least 60,032 metric tonnes of sand, thus causing a financial loss to the tune of Rs 1.4 crore to the state exchequer. The environmental degradation caused by the exercise is huge,” Kumar said.

He added, “Even complaints by the IAF (whose area this is) to the Haryana government have failed to yield any result. The importance of a natural sand belt along a river is ecologically crucial because it helps retain water in the river by slowing it down, and acts as a natural filter for debris to be cleared from the water.”

BENGALURU:  Chief Minister Siddaramaiah on Wednesday took officials to task over poor spending of funds earmarked under Scheduled Caste Special Plan (SCSP) and Tribal Special Plan (TSP).

In a review meeting held here, Siddaramaiah reportedly got upset and vented his ire at officials after coming to know that just 40 per cent of the allocated funds had been spent till December 2015.

The government had earmarked Rs 11,733.54 crore under SCSP for the year 2015-16, of which just Rs 4,616.06 crore was spent. Similarly just Rs 1,949.29 crore was spent out of the Rs 4,578.16 crore set aside under TSP.

“What were you doing all these days? I will not tolerate this kind of slack attitude. You should spend the entire money by the end of the financial year,” Siddaramaiah reportedly warned the officials.

The poor spending comes as a shocker for the state government which boasts of being the second state in the country after Andhra Pradesh having a legislation making it mandatory for 22 per cent of funds reserved for SC, STs in a given financial year.

While the Social Welfare Department has spent Rs 1,140 crore out of the Rs 2,933.26 crore under SCSP, the Tribal Welfare Department has spent just Rs 410.44 crore out of the Rs 1,052.9 crore (See box)

Siddaramaiah also reviewed the cases of atrocities on people belonging to SC, ST community being registered in the state and their progress.

Later speaking to reporters, the CM said, though the atrocities against SCs and STs have come down, the conviction rate in reported cases has been very low. “I have asked deputy commissioners and SPs to take steps to ensure the guilty are punished in atrocities cases,” he added.

He also said there was a demand for appointing an additional Advocate General to deal with cases of atrocities and he would consider it positively.

Social Welfare Minister H Anjaneya, Law Minister T B Jayachandra, Home Minister G Parameshwara and senior officials were present in the meeting.

Chennai: The Parliament enacts the law. The court interprets the law. So saying, Madras high court has refused to order rotation-basis reservation of president and vice-president posts in cooperative societies in Tamil Nadu.

Pointing out that cooperative societies have reservation for members but not for the post of president, the first bench of Chief Justice Sanjay KishanKaul and Justice PushpaSathyanarayana said, “this court cannot step in and assume the role of the parliament to, in fact, amend the constitution, which would be logical consequence, were the plea of the petition to be accepted. This is the role exclusively of the parliament, and this not a matter where the court can step in to fill a lacuna or gap.”

P Vijendran, counsel for S Karuppiah, founder of central and state government SC/ST Employees Federation, submitted that unless rotation basis reservation was provided, not a single cooperative society in the state would have a president or vide-president from SC or ST communities.

Advocate-general of Tamil Nadu A L Somayaji, however, demonstrated with data that out of 2.33 elected members in cooperative societies, 33,761 were from SC/ST communities. Of them, 1,545 became presidents of the respective societies, and 1,984 became vice-presidents. “This data has been shown in order to rebut the apprehensions of the petitioner, which are based on surmises and conjectures, as it is different from the ground reality which came into being,” argued Somayaji. There are 25,603 cooperative societies in the state, he said.

The first bench said there was no merit in the PIL, and said such a factual situation does not even exist.

On November 25, 1993, a fuming GautamWaghmare marched into Jai-bhimnagar in Nanded district and set himself on fire.

On January 14, 1994, the Maharashtra government formally announced that the Marathwadauniversity would be named after Dr B R Ambedkar.

It had been the budding lawyer’s long-time obsession, and undoubtedly, his burning last wish.

Twenty-two years after the incident, Gautam’s younger brother Shashikant recounts his sibling’s brilliance and dedication towards the cause, but also adds ruefully that life has not been easy for the family since then.

“My mother died in poverty at the age of 92 a few months ago. All she got was a paltry interest accrued on a sum of Rs 3 lakh that was allotted to her through the chief minister’s Relief Fund. I was hardly 16 years old when my elder brother passed away and had to shoulder the responsibility of the family since then. I could not opt for a proper education. After a follow-up that lasted nearly 12 years, I finally got a job as a peon in a local government office,” said Shashikant, who is based at Nanded, around 270 kms from here.

He adds, “My brother was a budding and talented lawyer, who was actively involved in the movement for empowerment of Dalits. He was the hope of the entire family, and could have easily revived our fortune had he been alive today. Nevertheless, we are extremely proud of him. His martyrdom will be remembered in the history of Dalit empowerment.”

Gautam had five elder sisters, and all of them were already got married before the incident.

TarabaiDhawale, one of his elder sisters, said the family had hoped Waghmare would become a judge.

“His performance in law studies was very good, and it raised our hopes further. All of us thought he would become a judge after completing his studies, and give a financial stability to home. He was closely tracking the movement of renaming Marathwada University since his school days and was agitated when the Maharashtra government resolved to rename it after DrAmbedkar in the late 70s,” she recalled.

Before Gautam had decided to take the drastic step, Shashikant says, he had submitted a memorandum to then chief minister SharadPawar through Nanded district collector on November 20, 1993, threatening that he would self-immolate if any further delay happened. “In his memorandum, my brother had accused the government for using the time-killing tactic on the issue, as more than 15 years had passed since the formal resolve from the government to concede the demand,” he said.

Shashikant said his brother had donated blood before immolating himself. “The district-level authorities did not pay any attention to his memorandum, taking it as yet another plea in writing. On that day, he first donated his blood and proceeded towards Jai-bhim Nagar. On his way, he came across a protest for the same cause. My brother told the leaders present that time had come to take decisive steps and that the ongoing protest would serve no purpose. He then purchased petrol and kerosene before reaching Jai-bhimnagar. There, he set a pyre from wood available nearby and set himself ablaze. Nearby women and passer-by tried to intervene, but could not stop him,” said Shashikant.

Advocate Ramesh Khandagale, who was then Marathwada region president of Dalit Panther group, said, “We reached Nanded as soon as news of his death arrived. Before immolating himself, Waghmare had written his wish to name Marathwadauniversity after Ambedkar,” he told ToI.

Writer and social thinker HrishikeshKamble said Waghmare sacrificed his life simply for his love and respect towards DrAmbedkar. “He was an educated and determined crusader in the Dalit empowerment movement, and chose to die for the cause he was fighting for,” he said.

As per records, Maharashtra government had passed the resolution for renaming the university on 27 July, 1978, but withdrew it after a month following reported tension and clashes.

“It was Gautam who, quite literally, lit the fire under them and they formally announced that Marathwada University will soon be DrBabasahebAmbedkar University on 14 January 1994,” said Shashikant.

In a bizarre practice, kiln workers belonging to upper caste are not willing to share rooms with lower caste labourers, let alone use the same kitchen to cook

Karimangar: The world may seem to be a much better place, with all sophistication and development, and authorities may be boasting about high standards of education, but the fact is, absurd practices are still prevalent in rural Telangana, much to the chagrin of civilised society.

In a classic example of ignorance and irrationality, brick kiln labourers of lower castes in Karimnagar district are being subjected to discrimination, by their own counterparts of upper castes. Though these labourers toil day in and day out to make their both ends meet despite caste differences,

when it comes to sharing of kitchen and night’s stay, workers belonging to lower castes have been kept at arm’s length by the so-called upper caste labourers, even as the owners of brick kiln units continuing to exploit them to the maximum. Apparently due to vehement caste sentiments, the labourers are not willing to unite against the injustice being done to them for long time.

Forgetter about kitchen, upper caste labourers do not share even shelters with lower community people. They demand brick kiln owners to set up shelters basing on caste.  Upper caste workers are not willing to stay if a lower caste family is allocated shelter in between their makeshift houses.

Keeping it in the mind, the owners of brick kiln units are constructing separate shelters based on caste since the district administration threatened to close down the units if the owners had failed to provide basic facilities including rooms, toilets, bathrooms, drinking water and schools for children of labourers.

Sharing his recent experience with The Hans India, Raju, owner of a brick kiln unit located near Sultanabad, said he had asked six male workers to stay in a room but four of them refused to stay along with remaining two persons stating that the two were lower caste people. Four labourers had been sleeping in a temporary shelter, he said, and added that they would not work if he mounted pressure on them.

Upper caste people did not accept if the roofs of their rooms shared with other castes workers, he informed. Another brick kiln supervisor, Kumar said they would not come forward to help lower caste people if a labour was injured in an accident.

Labourers belonging to different castes such as Patel (Reddy), Pujari of upper caste, Bagh (Goud), Yadava of Backward Classes, Deep, Luchan, Suna and Taria of Schedule Castes and Manji and Jani of Scheduled Tribes migrate to here to work in brick kiln units.

A migrant labour, Damuru, who is working in Garrepalli unit, said upper caste people would not allow lower caste people to stay along with them since it was common practice across the country.

‘Savarna fascism’ to be opposed

: Solidarity Youth Movement (SYM) of the Jamaat-e-Islami Hind will undertake a month-long campaign from January 15 in the State against the growing fascist tendencies ever since the NarendraModi government assumed power at the Centre.

The SanghParivarorganisations have deliberately made attempts to create a communal polarisation in the State. Kerala was also not an exception to the intolerance against minorities and Dalits as witnessed elsewhere in the country, the SYM State president T. Shakir and general secretary SadiqueUliyil said at a news conference here on Wednesday.

In this context, they said that a Dalit-backward-Adivasi-Muslim movement was the need of the hour to counter the “Savarna fascism” in the country.

The SYM will organise a programme to commemorate the 25 anniversary of Mandal Commission at Arayidathupalam ground on Thursday. The office bearers said that activist and writer KanchaIllaiah will inaugurate the programme at 4 p.m.

In a bid to undo the damage caused by its chief Mohan Bhagwat’s statements calling for a rethink on the reservation policy, the RashtriyaSwayamSevak (RSS) attempted to extend the olive branch to Dalits in the State. At a highly confidential meeting, the SaamarasyaVedike, a wing of the RSS, invited around 50 prominent members from the Dalit community, a majority being retired and serving bureaucrats, university vice-chancellors, educationists, social activists and politicians to interact with Bhagwat on Tuesday evening.

The meeting was such a hush-hush affair that even the BJP top brass were kept away and several senior leaders were unaware of the event.

Touted as a confidence–building exercise and to include Dalits into the BJP fold, Bhagwat, who was in the city to attend the Shrung Ghosh Shibir — Swaranjali 2016, at Yelahanka, met the community members at BMS College of Engineering on Bull Temple Road. The interaction, held between 6 pm and 8 pm, saw the main library hall packed.

“They sought our views to devise a strategy to consolidate Dalit support. Each of us was personally invited by the wing members to meet the RSS supremo,” said a retired IAS officer, who attended the interaction. Bangalore Mirror spoke to many of the officers who attended the meet, but none of them – whether serving or retired bureaucrats or politicians – wished to be identified.

Several were of the opinion that it was a strategy to mollify the community in the wake of the recent Bihar elections debacle. The disastrous poll results, according to political watchers, was also partly due to Bhagwat’s statement that reservation policy needs to be revisited, which did not go down well with the marginalised sections.

The RSS chief, who gave a patient hearing to the community members’ suggestions, views and grievances, assured them the RSS would work independently of BJP in understanding their problems, work on reforms to bring Dalits into the Hindu fold, and ensure they were accepted. He also spoke strongly about having common burial grounds, which would be a major step to bridge the class divide.

“The RSS has realised that it is inevitable to keep the Dalits within BJP, and unless Dalits are not taken into confidence, it is difficult for the party. Bhagwat wanted to get firsthand information of what the community in Karnataka feels. He also wanted to clear the air on the perceived misconceptions of the community about the RSS,” said a senior plitician.

While senior members of the community put across strong views, a few officers are said to have gone off tangent – expressing their grouse against bad postings, et al.

A retired bureaucrat pointed out that though Dalits felt they were part of the Hindu community, the latter have seldom accepted them. “In the fringes, there is some change and only about five per cent who are well educated, well-placed in different sectors are doing well. The remaining 95% are still the deprived class who are identified by the caste tag. Dalits are a part of Hindu society who should be brought to the mainstream with fellow Hindus,” stressed the bureaucrat.

Applicants belonging to Scheduled Caste and Scheduled Tribe should be given preference and be allowed to extract sand in Dakshina Kannada, according to a Dalit activist.

Speaking at a meeting of Dalit leaders here on Wednesday, activist Narayan accused the district administration of not considering applications by SCs and STs for grant of permits to extract sand. If permits are issued for SCs and STs it will provide the much-needed economic stability for the members of the community.

“These permits should not be given to those close to councillors and legislators,” he said. Deputy Commissioner A.B. Ibrahim, who heads the District Task Force to regulate sand extraction in coastal regulatory zone, said permits were issued to all those who had submitted their applications between January and April 2015. “Whoever has filed application has been given,” Mr. Ibrahim said and added that nearly 200 permits were issued.

Of the 500 applications filed since May 2015, the task force has granted permits to 75 persons. “Give me details of persons (belonging to SC and ST) who have submitted their applications. We will consider it,” Mr. Ibrahim said.

On the question of construction of AmbedkarBhavan in Urwa, District Social Welfare Officer Santosh Kumar said the process will start only after the State Cabinet approves the proposed sanction of Rs. 5.2 crore towards the construction cost.

Mr. Kumar said it was proposed to construct the Bhavan at a cost of Rs. 12 crore. The government has already released Rs. 2.4 crore, while the Mangaluru City Corporation will give a grant of Rs. 1 crore. The Commissioner for Social Welfare has agreed to sanction Rs. 3.5 crore. A proposal has been placed before the State Cabinet for sanction of Rs. 5.2 crore, he said.

Mr. Ibrahim said he will discuss with Deputy Conservator of Forests (Wildlife) regarding repair of narrow 3.5 km-long mud road connecting Alamba hamlet and Naravi that passing through Kudremukh National Park.

Communal representation is the accredited right of every nation and its government. It is the common right of all citizens belonging to every community. The main motive of the principle of communal representation is to eradicate the unequal status amongst the citizens. Communal representation is a ‘boon’ to create a society of equals. When there are communities which are forward and progressive; hampering the well being of all the other communities; there is no other go but to resort to the system of communal representation. It is by this way the suffering communities could begin to heave a sigh of relief. The need for the prolongation of the system of communal representation will automatically cease and it will be found absolutely unnecessary to continue the policy any longer, when all the communities are made as equals.

Excepting the Bráhmin community all other communities started to demand for communal representation soon after the talk of representation of Indians in governance began. For a long time, except the Brahmin community all other communities carried on agitation urging the government to implement the policy of communal representation.

Jinnah, Periyar and Ambedkar

The Brahmins, particularly the Brahmins of Tamil Nadu stooped to many ways to put hurdles and create obstacles against the implementation of the policy of communal representation. They pursued trickish methods and conspired many times against the communal representation policy which was a boon to all downtrodden communities.

One could understand the Brahmins opposing the communal representation policy, if at all they had openly come forward to list out the evils of uplifting the down trodden people. All those who oppose simply said ‘no’, and no one explained why? So far no one has clearly listed out the reasons for opposing the policy of reservation. What is wrong in making all people as equals? What is wrong in giving equal opportunities for all? If there is nothing wrong in creating a socialist society, and if it is undeniable that the present society composed of unequal should be made progressive; what else can be done without creating reservations based on population through the communal representation policy. Could it be denied that there are weaker section in the society?

Moreover, when we have allowed the classification of the society based on religion, caste and community; we cannot stand in the way of the people demanding special rights, based on religion, caste, and community. There is nothing wrong on their part or of any community in safeguarding their interests. I don’t see anything dishonest in that.

The casteism made the people go backward. Castes spell more and more ruination. Castes have made us low and have-nots. Till all these evils are eradicated and everyone attains an equal status in life, the proportional representation policy based ‘on population is indispensable. Many communities have entered the field of education only recently. All should be enabled to read and attain a civilised stage. Our people should take to education and read well. Our people should get their due share in the public services and in all other fields according to their percentage in the total population.

In this country out of 100 people only three are brahmins. Sixteen percent of the population are Adi-dravidas. 72 perent of the population are non brahmins. Should not the jobs be given to all in proportion to the population?
